How to buy
FAR 19.14
Competition restricted to certified SDVOSBs. We are certified, so an award to us counts toward the agency’s SDVOSB goal and toward a prime’s subcontracting goal.

Governmentwide, a contracting officer may award an SDVOSB sole-source contract up to $5 million ($8.5 million for manufacturing) where only one certified SDVOSB is expected to be responsive and the price is fair and reasonable. At VA, VAAR 819.7008 permits a sole-source award up to $5 million and does not require a determination that only one firm can perform.
We take subcontracts and we team. Since the FY2024 NDAA, only SBA-certified firms count toward a prime’s SDVOSB subcontracting goal — so our certification is worth something on your side of the ledger too.

The rules

The FY2024 National Defense Authorization Act (Pub. L. 118-31) raised the governmentwide prime contracting goal for service-disabled veteran-owned small businesses from 3% of eligible dollars to 5%.

SBA’s rule ending SDVOSB self-certification took effect 5 August 2024. A firm that had not filed a VetCert application by 22 December 2024 can no longer self-certify for a prime contract or subcontract that counts toward SDVOSB goals. We are certified by SBA, not self-certified.

Under 38 U.S.C. § 8127(d), VA contracting officers must restrict competition to veteran-owned small businesses whenever two or more are expected to bid at a fair and reasonable price. In Kingdomware Technologies, Inc. v. United States (2016) a unanimous Supreme Court held that this applies to all VA contracting determinations, not only until the department’s goals are met.

Yes, on both. We take subcontracts under a prime’s subcontracting plan, and we team where the AI or automation piece is the part that is missing. Since the FY2024 NDAA only SBA-certified firms count toward a prime’s SDVOSB subcontracting goal, so the certification does work on your side of the ledger as well as ours.
Encryption, access control, credential management and sandboxed execution — built for our own sensitive operations before any client’s. What we will not do is claim an authorisation we do not hold.
